Mesothelioma Solicitors

Our Mesothelioma Solicitors have a proven track record in providing expert legal advice and focus not just on the compensation, but also providing clients with the personal attention they deserve. They will come to your home (if you want them to) to discuss your case face to face.

Whilst we recognise that most people are not litigious and the idea of dealing with solicitors may frighten them, it is important to ensure that there is financial assistance available to Mesothelioma victims and their families. You are a victim of exposure to asbestos through no fault of your own.

Any compensation awarded helps to relieve the anxieties and costs associated with hospital visits, extra care in the home and other practical issues associated with the diagnosis and treatment of Mesothelioma.

Compensation is never regarded as a windfall but the settlement should effectively place you and your family in the same financial position as if you had not developed the Mesothelioma.
Due to the severity of the disease, our Mesothelioma Solicitors recognise that time is of the essence and always work quickly and efficiently to arrive at a final settlement.

Legally you have 3 years from the date that someone dies from the disease to make a claim. However, there may be extenuating circumstances that allow compensation claims to be made after 3 years. Our Mesothelioma lawyers can help you under these circumstances.

How long will it take a Mesothelioma Solicitor to settle a claim for compensation?

Some cases are more straight-forward than others. Some victims of Mesothelioma may have only been exposed to asbestos at a single company, for example The Gas Board or British Telecom.

The insurers of these companies will have processed many similar cases in the past, so our Mesothelioma Solicitors have relatively little work to do in processing the claim. Such claims may be processed in 2-3 months.

Many cases are more complex. It may take up to 50 or 60 years for the symptoms of Mesothelioma to develop - we have had several cases recently where exposure to asbestos occurred during the second world war. Many companies that were trading decades ago have now ceased trading, so it becomes more challenging for our lawyers to trace the insurers.

Why choose our Mesothelioma Lawyers?

Our Mesothelioma Solicitors do have access to information and databases not available to the general public and are experts in finding companies to bring the claims against.

Our lead solicitor has successfully made claims from many employer's insurance companies across England and Wales on behalf of employees including well known employers such as Royal Navy, Atomic Weapons Establishment, Foster Wheeler and in the last 3 years has recovered over £5m for asbestos victims.

Over the 20 years that our solicitors have been helping victims of Mesothelioma, we have had many successful claims that were rejected by other law firms.

Claims are rejected for a variety of reasons, usually because of the complexities associated with tracing the insurers of companies that ceased trading long ago. Or simply not asking the right questions.

Mesothelioma can be caused be a relatively small amount of exposure to asbestos and sometimes you simply cannot imagine when or where the asbestos exposure took place.

Due to the vast experience of our Mesothelioma Lawyers, they will know the right questions to ask. It may be that you were exposed in the home, at school or secondary asbestos exposure, for example washing clothes.

Our Mesothelioma Law Firm guarantees to maximise the value of you claim.
There are a variety of factors that determine the amount of compensation that may be paid out, these include:

  • The age of the claimant
  • The amount of exposure to asbestos
  • Where this exposure took place
  • Projected loss of earnings as a result of developing the disease
  • Number of dependents and their needs

This is illustrated by a case our lead Mesothelioma Lawyer handled recently where compensation in excess of £750,000 was awarded to the victim's family.

Can a Mesothelioma Solicitor advise on Government Schemes and Benefits

There are circumstances under which an insurer cannot be traced - even by our solicitors. When this happens, they will be able to advise you on claiming monies from a new government scheme. The UK Government, under the Mesothelioma Bill, will provide a certain amount of compensation provided the date of diagnosis is after July 25th 2012. This amount will be less than would be awarded if an insurer can be traced (usually 80% of the average civil claim settlement), so it is worth investigating all other possibilities with our Mesothelioma Lawyers. If you receive monies from this scheme and our solicitors manage to find the insurers of your former employer and put in a claim against them, you can still receive compensation from the insurer but this would be reduced by the amount paid out by the government scheme.

The government can also provide an interim settlement while the case is being built. This amount will be deducted from the final settlement, but you can be paid relatively quickly - usually with about 6 weeks. Our Mesothelioma lawyers will help you with this too.

Other entitlements may include industrial injuries disablement benefit. Our solicitors will be able to advise you on this when they contact you.
