Asbestos Claim against NHS Hospital Trust |
| Mr Humphrey developed pleural thickening as a result of his exposure to
asbestos whilst working as an electrician between 1978 to 1989 at the Queen Elizabeth Hospital in Gateshead.
Unfortunately Mr Humphrey had a complicated medical condition unrelated to his asbestosis which was calculated at 10%
of the total disability. |

| Proceedings were commenced and the hospital subsequently denied liability
producing witness statement from a former engineer confirming all asbestos had been removed. Defendants denied causation
on the basis that the claimant did not have an asbestos related condition and that in any event the claim was statute
barred and the claimant knew or ought to have known that he had an asbestos related condition within three years before
proceedings were commenced. |

| The case was listed for trial on the 01 December 2005 and shortly before trial
the defendants made two offers to settle, the second of which was accepted by the claimant. |
