| Proceedings were commenced on behalf of Mrs Naisbit whose husband developed
mesothelioma in the late summer of 2003 at the age of 59. Mr Naisbit was very fit and active and had the previous
year had successfully completed the Coast to Coast cycle ride from Barrow in Furness to Sunderland. When Mr Naisbit
was struck down with mesothelioma the impact on his wife and family was devastating. Mr Naisbit died in February 2004
leaving a wife and two children. |

| Court proceedings were commenced in January 2005 having been no response from
the insurers to any of the allegations of negligence and although a defence was filed the defendants denied liability.
No offers put forward to settle, the case was heard at the Middlesbrough County Court on the 10th January 2006 where
the claimant was awarded compensation of £187,000 |
