  JAMES NAISBIT (DECEASED) V SWAN HUNTER AND OTHERS
Proceedings were commenced on behalf of Mrs Naisbit whose husband developed mesothelioma in the late summer of 2003 at the age of 59. Mr Naisbit was very fit and active and had the previous year had successfully completed the Coast to Coast cycle ride from Barrow in Furness to Sunderland. When Mr Naisbit was struck down with mesothelioma the impact on his wife and family was devastating. Mr Naisbit died in February 2004 leaving a wife and two children.
Court proceedings were commenced in January 2005 having been no response from the insurers to any of the allegations of negligence and although a defence was filed the defendants denied liability. No offers put forward to settle, the case was heard at the Middlesbrough County Court on the 10 January 2006 where the claimant was awarded compensation of £187,000.

  ROBERT McINNES V BARTON ELECTRICAL ENGINEERING, SWAN HUNTER SHIPBUILDERS
Mr McInnes, aged 58, was employed as an electrician with London Transport when he developed mesothelioma in October 2002 and died from his illness in March 2004.
Mrs McInnes, his wife, was devastated by the loss of her husband and was very reluctant to pursue a claim for damages. She was persuaded to do so by family and friends who gave her support throughout the claim.
Proceedings were commenced in January 2005. The defendants admitted liability making an offer to settle three months before trial in the sum of £110,000. This is a familiar tactic by defendants who are aware that widows in particular are vulnerable and therefore susceptible to any sort of significant offer and despite the reluctance of the claimant she was persuaded to reject the defendants offer and received an award of £200,000.

  FREDERICK HUMPHREY V QUEEN ELIZABETH HOSPITALS NHS TRUST
Mr Humphrey developed pleural thickening as a result of his exposure to asbestos whilst working as an electrician between 1978 to 1989 at the Queen Elizabeth Hospital in Gateshead.
Unfortunately Mr Humphrey had a complicated medical condition unrelated to his asbestosis which was calculated at 10% of the total disability.
Proceedings were commenced and the hospital subsequently denied liability producing witness statement from a former engineer confirming all asbestos had been removed.
Defendants denied causation on the basis that the claimant did not have an asbestos related condition and that in any event the claim was statute barred and the claimant knew or ought to have known that he had an asbestos related condition within three years before proceedings were commenced.
The case was listed for trial on the 01 December 2005 and shortly before trial the defendants made two offers to settle, the second of which was accepted by the claimant.
 
NB. In all three cases the claimants received their damages in full and their legal costs recovered from the defendants.
