House Of Lords Saves Insurers £1.4 Billion |

It is now common knowledge that the House of Lords removed an established right to compensation for the symptomless
Pleural Plaques. |

This type of claim had been routinely accepted by the Courts for over 20 years.
The Judgment brought an end to claims for psychiatric illness caused by anxiety and the distress of
learning about the presence of Pleural Plaques and the fear of developing a more serious condition.

The main points found by the House of Lords:

1. Symptomless Pleural Plaques are not damage in themselves. Pleural Plaques may be an “injury”
but they have no effect and do not in themselves cause damage in the future or amount to damage.

2. Psychiatric Injury. An employer would unlikely have known how a particular employee was to react
to the risk of asbestos related injury more than 30 years ago after he left the employer’s employment.
